Mthatha: The Hawks’ Priority Crime Specialised Investigation unit and the National Prosecuting Authority have successfully secured a preservation order in a significant kidnapping and murder case. The Mthatha High Court granted the order, targeting a silver grey and white Mitsubishi valued at R100,000.
According to South African Government News Agency, the case demonstrates a strategic use of asset forfeiture to combat crime. The case originated from the abduction of a victim on 17 January 2023, who was allegedly accused of stealing the personal property of the accused. This accusation led to a violent act where the victim was severely assaulted and then taken to a remote forest area using a vehicle controlled by the culprits, as per a statement from the Hawks.
A Missing Person Enquiry was initially launched following the incident. However, through detailed investigative work and consultation with prosecutors, the case was reclassified, leading to the registration of charges of kidnapping and murder. The accused were identified as Andile Tyusha, aged 52, and Olwethu Mampofu, aged 37.
Despite extensive search operations by law enforcement, the victim remains missing, adding to the complexity of the case. The criminal proceedings are ongoing, with the trial scheduled for 25 May 2026 at the Mthatha High Court. The preservation order prevents the use of the asset until the case is resolved.
