Johannesburg: Eskom has complied with a recent Supreme Court of Appeal (SCA) judgement to disclose certain contracts to AfriForum under the Promotion of Access to Information Act (PAIA). In a statement on Monday, the power utility announced it has fulfilled the SCA's 23 March 2026 court order, which upheld an earlier High Court judgment, to provide AfriForum with access to historical primary energy and electricity supply contracts active as of July 2022.
According to South African Government News Agency, these contracts are categorized into four distinct groups of legacy operational contracts. These include the Independent Power Provider (IPP) list, which details all IPPs feeding electricity into the national grid; active coal distribution, transport, and coal purchasing contracts; active diesel purchasing contracts; and contracts for the supply of electricity to neighboring countries. The power utility had initially noted the court's ruling in March and studied the judgment.
Eskom's statement from March indicated that the Supreme Court of Appeal in Bloemfontein dismissed Eskom's appeal with costs, reaffirming the Gauteng High Court's directive for Eskom to grant AfriForum access to specific coal, diesel, and transport contracts. Meanwhile, Eskom also provided an update on its investigation into the diesel procurement and storage contract tender MWP2197GX. The Group Investigations and Security (GIS) function is finalizing a forensic investigation into potential irregularities within this contract.
Eskom's investigation was initiated after monitoring contract performance during operational emergencies involving load shedding in 2025, alongside information acquired through established reporting and whistleblowing channels. Eskom's statement emphasized that the investigation demonstrates its evolving risk management controls, transparency, and accountability. The final report is anticipated by mid-June 2026, and Eskom plans to pursue criminal or civil recoveries where deemed appropriate.
